Matthew E. Meyers is a member of Berman, Sauter, Record & Jardim's Construction Litigation group. Mr. Meyers has extensive experience litigating complex civil matters arising from construction defects. He has represented homeowner associations, condominium associations, developers, general contractors and subcontractors in all aspects of complex litigation, including trials, arbitrations, mediations, and appeals. Mr. Meyers serves on the Community Associations Institute, New Jersey Chapter, 2011 Conference Seminar & Sponsorships Work Group. He also is a member of the Roxbury (New Jersey) Planning Board for 2012. During college and law school, Mr. Meyers served as a Construction Manager for one of the largest developers in the NY/NJ metropolitan area.
Mr. Meyers recently settled over $11,000,000.00 in claims on behalf of several condominium associations:
*Mr. Meyers was lead counsel for a condominium association in a complex construction defect case that settled for $5,900,000 shortly before trial. The litigation involved massive structural damages resulting from water infiltration that was due to improperly installed EIFS, brick, vinyl, roofs, and windows.
*Mr. Meyers represented a condominium association in a complex construction defect case which settled for over $4,000,000 during mediation. The litigation arose from severe damage to multiple town homes emanating from water infiltration that was due to improperly installed roofs, EIFS, and decks.
*Mr. Meyers was lead counsel for a condominium association in a complex construction defect case which settled for $1,200,000 during mediation. The litigation centered around damages to the association from water infiltration due to improperly installed roofs and windows.
Mr. Meyers currently represents a large, luxury condominium association on the Hudson River with claims over $60 million due to excessive sinking as the result of subsurface conditions and geotechnical engineering issues. Additionally, the association is experiencing massive water infiltration due to poorly constructed roofs, balconies, and windows as well as improperly installed brick, EIFS, and vinyl.
Mr. Meyers also represents several other associations that are currently pursuing multi-million dollar claims against developers and contractors, including:
*An active adult community in Essex County with 13 mid-rise buildings that are experiencing massive water infiltration through roofs, stucco, manufactured stone veneer, and balconies, with a claim in excess of $10 million.
*A community association in Essex County with over 500 units, experiencing serious water infiltration through roofs, EIFS, brick, vinyl, and MDO paneling, with a claim in excess of $10 million.
*A community association of 11 mid-rise buildings in Somerset County experiencing water infiltration through roofs, EIFS, brick, balconies, and vinyl, with a claim in excess of $4 million.
*A community association in Hudson County with a high-rise building built upon a crumbling retainer wall.
*A community association in Morris County with 15 mid-rise buildings, experiencing water infiltration through roofs, vinyl, and brick.
Mr. Meyers is a frequent speaker on topics related to construction law. He was a lead speaker at the Association of Owners and Developers meeting in Atlanta on September 20, 2010, and again in New Orleans on October 25, 2010. He spoke about representing associations and the plaintiff's perspective when an association is faced with construction defects left behind by the developer and its subcontractors.
Mr. Meyers' most recent speaking engagements included the 2011 Community Associations Institute (NJ) Educational Series on March 24, 2011, on the topic of "Mold Remediation Issues"; and a NJICLE seminar on "Construction Defects" on June 8, 2011.
