real estate transactions. The Firm regularly represents
commercial real estate purchasers, sellers, landlords
and tenants and has been involved in numerous complex
transactions, including those requiring consideration
of significant tax issues, such as like-kind exchanges.
In connection with its transactional work, the real estate
department regularly counsels its clients with respect to
lending and financing matters.
Planned Real Estate Development
The Firm has significant experience in planned real estate
developments, such as residential, commercial, and mixed use
condominiums; cooperatives; and planned unit developments,
including preparation of public offerings for residential
and mixed-use condominium developments, registrations
with the New Jersey Department of Community Affairs,
and the conversion of rental properties to condominium
ownership.
Land Use The Firm's Real
Estate Department provides legal services in virtually all
aspects of real estate matters, including zoning and planning.
Our real estate attorneys regularly appear before planning
boards and zoning boards in connection with procuring
subdivision, site plan and variance approvals. Berman,
Sauter, Record & Jardim's development clients rely on the
ability of the Firm's attorneys to coordinate and prosecute
complex land use matters. In that regard, the Firm frequently
participates in the procurement of permits and approvals
from the NJDEP, NJDOT, county planning boards and soil
conservation districts. The Real Estate Department frequently
prepares governing documents and registration statements for
various forms of planned unit developments and obtains the
required approvals from the Department of Community Affairs.
The Firm regularly represents developers of residential,
retail and commercial projects in land use matters.
